1. Acceptance of these Terms
By accessing or using Rich Palette™, including its website, progressive web app, mobile application, account services, Cloud AI tools, cloud library, downloads, and related features (the “Service”), you agree to these Terms of Service and the Privacy Policy. If you do not agree, do not use the Service.
2. The Service
Rich Palette provides creative color tools such as palette generation, image-based color extraction, color analysis, accessibility utilities, palette organization, cloud storage/synchronization, professional exports, and optional AI-assisted color direction. Features may change, improve, be added, be limited, or be discontinued over time.
3. Accounts
You are responsible for providing accurate account information, protecting your password and email account, and for activity occurring through your account. You may not share credentials in a way that compromises account security or use another person's account without authorization. Notify us through the contact form if you reasonably believe your account has been compromised.
4. Your creative content
You retain ownership of original content and creative materials you provide to Rich Palette, including palette names, notes, prompts, and other content that you have the right to use. You grant Gilded Echoe Studio™ a limited permission to host, process, transmit, reproduce, or format that content only as reasonably necessary to provide, secure, support, and improve the Service.
You are responsible for ensuring you have the rights needed to use any images, brand assets, client materials, text, or other content you submit.
5. AI-assisted features
Cloud AI features are creative-assistance tools. AI-generated colors, names, explanations, recommendations, and other outputs may be incomplete, unexpected, inaccurate, or similar to outputs provided to others. You are responsible for reviewing outputs before relying on or commercially using them. Rich Palette does not promise that AI output is unique, protectable by intellectual-property law, suitable for a particular purpose, or free of third-party rights concerns.
6. Rich Palette Pro, trials and subscriptions
Rich Palette Pro may be offered through Stripe on the Rich Palette website, Google Play in the Play-distributed Android app, or another authorized billing channel. The planned launch offers are $4.99 per month or $39.99 per year, with a 7-day free trial for eligible new subscribers. Trial eligibility is account-based and may be limited to one introductory trial. The checkout screen shown by the billing provider controls the final price, currency, taxes, eligibility, renewal date, and offer terms.
Unless canceled before renewal, a subscription may automatically renew according to the billing terms shown at purchase. Website subscriptions can be managed through Stripe's secure customer portal; Google Play subscriptions can be managed through the subscriber's Google Play account. A verified active Pro entitlement may be honored on other supported Rich Palette surfaces when the customer signs into the same Rich Palette account. Refunds, where available, are governed by the applicable billing channel, our policies, and applicable law. We may change pricing or plan features prospectively as permitted by the billing platform and applicable law.
7. Usage limits
Some resource-intensive features may have fair-use or plan limits. Cloud AI usage may be limited by trial, daily, monthly, abuse-prevention, or service-capacity allowances. Reaching a Cloud AI limit does not necessarily disable the rest of Rich Palette. Limits may be adjusted for reliability, cost control, product evolution, or abuse prevention, with appropriate in-app disclosure for material plan changes.
8. Acceptable use
You agree not to misuse the Service, attempt to bypass authentication or subscription controls, probe or exploit security vulnerabilities, interfere with other users, automate abusive volumes of requests, introduce malicious code, scrape private user data, reverse engineer protected server-side systems where prohibited by law, use the Service to violate applicable law, or use content in a way that infringes another person's rights.
9. Rich Palette intellectual property
The Rich Palette™ and Gilded Echoe Studio™ names, logos, branding, interface design, original artwork, documentation, proprietary software, and other materials supplied by Gilded Echoe Studio™ are owned by or licensed to Gilded Echoe Studio™ and are protected by applicable intellectual-property laws. These Terms do not transfer ownership of those materials to you.
10. Third-party services
Rich Palette relies on third-party infrastructure and services, which may include Supabase, OpenAI, Resend, Cloudflare, Stripe, Google Play, and other technology providers. Their availability, terms, and services are outside our direct control. Your use of app-store billing and certain integrated services may also be subject to separate third-party terms.
11. Availability and changes
We aim to provide a reliable Service, but Rich Palette may occasionally be unavailable due to maintenance, network conditions, third-party outages, security events, updates, or circumstances beyond reasonable control. We do not guarantee uninterrupted or error-free availability.
12. Disclaimer
To the fullest extent permitted by applicable law, the Service is provided on an “as is” and “as available” basis. Rich Palette is a creative design tool and does not provide legal, financial, medical, trademark-clearance, copyright-clearance, accessibility-certification, or other regulated professional advice. You remain responsible for final design, production, accessibility, licensing, and business decisions.
13. Limitation of liability
To the fullest extent permitted by applicable law, Gilded Echoe Studio™ will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, or business opportunities arising from use of or inability to use the Service. Nothing in these Terms excludes liability that cannot legally be excluded or limited.
14. Suspension and termination
We may restrict or terminate access where reasonably necessary to address fraud, abuse, security risks, nonpayment, material violations of these Terms, legal requirements, or threats to the Service or other users. You may stop using Rich Palette at any time. Subscription cancellation does not automatically delete an account unless you separately request account deletion.
15. Changes to these Terms
We may revise these Terms as Rich Palette evolves. The current version will be posted on this page. Where appropriate, material changes may be communicated through the Service before they take effect.
16. Applicable law
These Terms are governed by the laws that apply to Gilded Echoe Studio™ and the transaction or user at issue, without limiting non-waivable consumer rights that may apply in your jurisdiction.
